


The Western Cape Department of Environmental Affairs and Development Planning (DEA&DP) on 15 May 2026 granted Environmental Authorisation to the City of Cape Town for the proposed dredging of the Milnerton Lagoon, in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998) and the 2014 Environmental Impact Assessment Regulations (as amended). Various appeals were lodged against this decision in compliance with the National Appeal Regulations, 2025 (Government Notice No. R. 5985 in Government Gazette No. 52269 of 13 March 2025).
In terms of the National Appeal Regulations, an Applicant must notify, and make a copy of the appeal[s] available to, registered interested and affected parties where applicable, and to affected organs of state, within 5 calendar days of the expiry of the 20-day appeals period. In terms of the regulations, the applicant, the decision-maker and any other person contemplated in regulation 4 may, within 20 calendar days from the date of receipt of the appeal, submit a statement responding to an appeal, to the appeal administrator and to the appellant.
