Heritage Western Cape and the City of Cape Town
Application in terms of Section 34(3) and Section 38(9) of the NHRA
Heritage Western Cape, supported by the City of Cape Town, is considering implementing the following sections of the National Heritage Resources Act 25 of 1999 (NHRA) in the demarcated area within the Ottery/Lansdowne precinct.
At present, any person wanting to alter or demolish a structure over 60 years in the demarcated Ottery/Lansdowne Area must apply to HWC for a section 34(1) permit to do so, in terms of the NHRA. Should an exemption for the demarcated Ottery/Lansdowne Area be approved, application to HWC for a section 34(1) permit will no longer be required, nor will notifications of the intention to develop in terms of section 38(1).
- Section 30(2): Listing heritage resources in the Ottery/Lansdowne Area in the heritage register.
- Section 34(3): Exempting specific areas from compliance with section 34(1) of the NHRA. The effect of these exemptions will be that application to Heritage Western Cape for a section 34(1) permit to alter or demolish any structure within the defined areas will no longer be required.
- Section 38(9): Exempting specific areas from compliance with section 38(1) of the NHRA. The effect of these exemptions will be that notifications to the responsible heritage authority regarding the provisions of section 38(1) within the defined areas will no longer be required.

Description of geographical area:
The demarcated Ottery/Lansdowne Area is located in the east area of the City of Cape Town within the Tygerberg planning district of the Cape Town metropole.
The following erven within the Ottery/Lansdowne Area (ie: the exemption area) will be subject to the section 34(3) and section 38(9) exemptions only once they have been considered for placement on the heritage register (section 30 of the NHRA) and protected through the City's heritage protection overlay zoning. The inventory of grade III heritage resources are erven:
CA623, CA26-RE, CA621, CA619-RE (portion), CA619-RE

Erfenis Wes-Kaap, ondersteun deur die Stad Kaapstad, oorweeg dit om die onderstaande gedeeltes van die Wet op Nasionale Erfenishulpbronne (Wet 25 van 1999) in die afgebakende gebied binne die Ottery/Lansdowne gebied.
Tans moet enige persoon wat 'n struktuur oor 60 jaar in die afgebakende gebied wil verander of sloop, by Erfenis Wes-Kaap aansoek doen om 'n artikel 34(1)-permit. Indien 'n vrystelling vir dié gebied goedgekeur word, sal aansoek by Erfenis Wes-Kaap vir 'n artikel 34(1)-permit nie meer vereis word nie, en sal kennisgewings van die voorgenome ontwikkeling ingevolge artikel 38(1) ook nie vereis word nie.
- Section 30(2): Lys van erfenishulpbronne in die Ottery/Lansdowne -gebied in die erfenisregister.
- Artikel 34(3): Vrystelling van die afgebakende Ottery/Lansdowne -gebied van voldoening aan artikel 34(1) van die Nasionale Erfenishulpbronne.
- Artikel 38(9): Vrystelling van die afgebakende Ottery/Lansdowne -gebied van voldoening aan artikel 38(1) van die Nasionale Erfenishulpbronne.

Ligging:
Die Ottery/Lansdown-gebied is geleë in die sentrale/suidelike gebied van die Stad Kaapstad binne die beplanningsdistrik van die Kaapse Vlakte. Die gebied sluit die voorstad Ottery in, asook 'n klein gedeelte van Philippi langs Govan Mbekiweg.
Die volgende erven binne die Ottery/Lansdown-gebied (die vrystellingsgebied) sal onderhewig wees aan die artikel 34(3) en die artikel 38(9)-vrystellings slegs sodra dit oorweeg is vir plasing op die erfenisregister (Artikel 30 van die Nasionale Erfenishulpbronne) en beskerm word deur die Stad se erfenisbeskermingsoorlegsonering. Die inventaris van graad III-erfenishulpbronne is erven:
